Seminar on Arbitration and Mediation of Intellectual Property Cross border Transaction Disputes

The seminar was held on 24 November 2024 at the China Trademark Festival, this year based in the historical ancient city of Xi’an, in Shaanxi Province of China.

The seminar was co-organized by the China Trademark Association (CTA) and Macao Victory Group International with the support of several organizations including the AIPPI China, the Mediation Centre of the CCPIT, The Guangdong Intellectual Property Research Association, Guangdong Trademark Association and local law firms Shaanxi Yingjiu Law Firm and Shaanxi Fengrui Law Firm.

Mr. Zhang Yunning, deputy secretary general of China Trademark Association, Mr. (Richard) Yi Li, secretary general of AIPPI Chinese Group, as well as newly elected assistant reporter general, Ms. Mamta Rani Jha gave opening remarks at the Opening setting the stage for the keynote speakers and panel sessions, which was moderated by Mr. Lee Nai Zhe, HK Regional Managing Director of Macao Victory Group International.

Keynote speeches were delivered by Mr. Yao Junyi, deputy secretary-general of the Mediation Center of China Council for the Promotion of International Trade (CCPIT), providing a robust “Case Analysis of Cross-Border Intellectual Property Transactions and Investment Disputes. Ms. Amy Wong – member of AIPPI Standing Committee on ADR, and Co-Chairwoman of ADR Special Committee of AIPPI Chinese Group followed on with her talk in relation to “The Advantages of building a Cross-Border IP Transaction Disputes Settlement Centre in Macau.” Afterwards two round panel discussions were held.

The first panel, conducted in Chinese, was entitled ‘Current updates, experience and outlook of dispute resolution in Intellectual Property transactions in China,’ and it was moderated by Ms. Zhao Hongyan, director of Shaanxi Yingjiu Law Firm. The panel included exchanges and updates between the deputy director and secretary general of Xi’an Arbitration Commission, representatives from CCPIT Patent and Trademark Law Office, Zhiguo Group, the IP professional committee of Shaanxi Lawyers Association, and Shaanxi Fengrui Law firm.

The second panel, conducted in English, was entitled ‘ADR & International Intellectual Property Trade Disputes,’ and was moderated by Mr. Sunny Chandra, International IP Director Of Macao Victory Group International. Panelists included representatives from Singapore, USA, South Africa, India, and Russia.

The Keynote speeches provided pertinent updates on current topics and new developments in the ADR and IP space. The panel sessions equally gave the audience, consisting mostly IP attorneys, lawyers, IP agents and other professionals important updates both in China and around the world on the latest happenings and development strategy for engaging in ADR mechanisms among different jurisdictions, both locally in China and globally. Closing remarks and the session was concluded by Mr. Yanfeng Xiong, newly elected assistant reporter general of AIPPI.
