Turkish Patent and Trademark Office (“Turkish PTO”) has become the sole authority to handle trademark cancellation actions as of 10 January 2024, but it has not been able to process such actions due to lack of Implementing Regulation and lack of other official necessities. With the required Implementing Regulation having gone into effect as of 15 March 2025, it appears that the Turkish PTO will start processing trademark cancellation proceedings.

Trademark cancellation actions were exclusively court actions in Turkiye. Turkish IP Law (Law no. 6769), which went into force in 2017 has transferred the authority to handle trademark cancellation actions from courts to the Turkish PTO, but such transfer of authority was postponed with a provisional article of the Law no. 6769 until 10 January 2024.

Despite the arrival of 10 January 2024, there were neither an Implementing Regulation for Turkish PTO’s handling of trademark cancellation actions, nor official fee for trademark cancellations. As a result, Turkish PTO has not been able to process such actions.

Official fee for trademark cancellation actions was posted on 24 April 2024 but there still was no Implementing Regulation. The Implementing Regulation for trademark cancellation actions was posted and has come into force on 15 March 2025, as amendments of and/or additions to several provisions to Implementing Regulation to the Law no. 6769, which has removed the last hurdle before administrative processing of trademark cancellation actions.

It appears that the Turkish PTO is finally ready and has all groundwork to process trademark cancellation actions, well over a year after it becamethe sole authority to handle such actions.
