The CJEU’s judgment on 25 February 2025 in BSH Hausgeräte GmbH v Electrolux AB has far-reaching implications for cross-border patent litigation in Europe.  In this webinar, members of AIPPI’s Enforcement and Patent Standing Committees will discuss the judgment and consider its implications from a number of perspectives, both within and outside the European Union.

Stefania Bergia, Vice Chair of the Enforcement Committee

Stefania Bergia heads the IP Practice of the Italian office of Simmons & Simmons in Milan. She regularly assists clients on a pan-European level, on an extensive range of judicial and extra-judicial matters of IP law, including patents. She is member of the Executive Committee of AIPPI Italia, President of the Italian Patent Group and Co-Vicechair of the Enforcement Committee of AIPPI International. She is regularly a speaker at IP conferences and authored publications in the IP field. She teaches i) at WIPO-Harvard Law School Course in Patent Law and Global Public Health; ii) at the Industrial Property Course-Patents organized by the Department of Energy of Politecnico di Milano; iii) at postgraduate courses; iv) she taught at the University of Parma the course “Legislation and Patents – Chemical and Biotech Patents and GMO Legislation”. Member of the Editorial Board of the most important Italian legal journal on IP. Stefania holds a PhD in IP Law from the University of Parma. She is listed in The Legal 500 and ranked in Chambers Global / Europe and in IP Stars as a Patent Star in the patent strategy and counselling category.

Koen Bijvank, Chair of the Patents Committee

KOEN BIJVANK is a partner at Brinkhof in Amsterdam, the Netherlands. He is qualified both as an attorney at law (‘advocaat’) and as a Dutch and European patent attorney. He specializes in international patent litigation and oppositions before the European Patent Office. His practice mainly involves patents in the areas of life sciences and pharmaceuticals. Koen is the chair of the Standing Committee on Patents of AIPPI and co-founder and past-president of EPLIT, an association of European patent litigators. He is also a member of the editorial board of the BIE, a leading Dutch journal on intellectual property, and a tutor at CEIPI in Strasbourg, France where he teaches candidates for the qualifying examination for European patent attorneys. Koen holds a master’s degree in organic chemistry of the University of Groningen, the Netherlands and a LLM and postgraduate certificate in intellectual property litigation of Nottingham Law School in the United Kingdom.

Pete Damerell, Chair of the Enforcement Committee – Moderator

Pete Damerell is a partner at Powell Gilbert, www.powellgilbert.com, a specialist European IP firm. He has extensive experience in handling complex and high value patent litigation before the UK courts (including up to the Supreme Court) and is a UPC representative. He also commonly advises clients on – and then co-ordinates – pan-European patent litigation strategies. He is experienced in working with a diverse range of technologies, including pharmaceutical products and formulations, biotechnology, medical devices, telecommunications and engineering. Pete is Chair of AIPPI’s Standing Committee on Enforcement, as well as a member of the Licensing Executives Society and the European Patent Lawyers Association. He has been recognised as a Next Generation Partner by Legal 500 and is recommended in IAM Patent 1000: World’s Leading Patent Professionals, JUVE Patent UK and WIPR Leaders 2024.
