European Trade Mark Reform Legislative Package

Important changes in European trade mark practice are to take effect March 23, 2016 following the adoption by the European Parliament of the EU trade mark reform legislative package on December 15, 2015 and its publication in the Official Journal of the European Union on December 24, 2015. Among the various changes to take place on March 23 will be the renaming of OHIM to the EU Intellectual Property Office (EUIPO) and the Community trade mark (CTM) to the EU trade mark (EUTM).

 

OHIM’s practices are reflected in its respective Guidelines on both trade mark practice and designs practice. OHIM is conducting a consultation process with respect to revised draft Guidelines addressing the changes resulting from this reform (https://oami.europa.eu/ohimportal/en/draft-guidelines-wp-lr). These are currently being reviewed by AIPPI’s Trademarks and Designs Committees.
